Search trademarks using the Trademark Electronic Search System (TESS) Trademark Electronic Search System (TESS) The Trademark application Serial Number is: 77056496 Resorts International Holdings, LLC filed for three International Trademark Classes: 035 - MARKETING AND ADVERTISING SERVICES IN CONNECTION WITH THE PROMOTION OF APPLICANT'S CASINO PLAYER REWARDS PROGRAM 041 - ENTERTAINMENT, NAMELY CASINO SERVICES, IN CONNECTION WITH CASINO PLAYER REWARDS PROGRAM 043 - Casino gaming and hotel and restaurant services, namely, a frequent customer reward program that enables patrons to earn discounts and complimentary gifts However, on January 26, 2007, they were refused trademark as a result of likelihood of confusion, merely descriptive, and activity not a service. Interestingly they found many references to “Destination Club” to the various destination clubs that this forum focuses on. They reapplied again in July, but were refused again on September 3, 2007. ------------------------- I am not an attorney, but any attempt to trademark the phrase “Destination Club” could have negative ramifications for the entire Destination Club industry and all destination clubs. This is something the DCA should be investigating. |

Club: DC4MS.com | Renaissance Cruises was granted a US trademark for the mark "Destinations Club" International class 39 on May 16, 2000. Registration number 2350416 However this was canceled on February 24, 2007 |

Club: DC4MS.com | I sent this thread to Adam Wegner, SVP and General Council, Exclusive Resorts and General Council for the DCA and I will post a summary of what he said. He did not want me to post his exact e-mail response as his company's policy is NOT to post on public forums. I, personally, find this particular company policy to be very "amusing" considering Steve Case (Majority Owner of Exclusive Resorts) was the co-founder and former CEO of American Online, was the chairman of AOL Time Warner, and even publishes his own Blog on Revolution Health. Perhaps they will reconsider this policy in the near future. ![]() --------- The DCA feels that the trademark for the mark "Destination Club" is not something that the industry association believes should be subject to trademark registration by a company. The DCA believes that the term “destination club” is purely descriptive of a category of business and it should not be eligible for trademark protection by a particular company. -------- So far the PTO has denied any attempts to trademark the words "Destination Club" and Destination Club Forums will continue to monitor this topic. We also believe that it is very important that there be a common understanding and agreement upon basic terms (such as Destination Club) to separate this business from timeshares, fractionals, and condo-hotels. I am not sure who first coined this term, but is has stuck largely due to the result of the press and public using this term, rather than any branding efforts being undertaken by different clubs. In fact, Exclusive Resorts previously used the term “luxury residence club” to describe its business and now prefers the term "Luxury Destination Club." |
