Club: Chapter 7 | Subject: Success Plan Update To: Received: Thursday, November 13, 2008, 11:19 AM Dear High Country Club Member, Thank you for all of the time and effort each one of you has made to evaluate the Success Plan. Over the past 3 weeks, we have worked night and day to develop a plan that could help HCC get through the paralyzing circumstances the economy brought to our company on September 14th. On Monday, we announced a revised Success Plan that took into account the 264 yes votes and the high number of downgraded memberships included in the 264 yes votes. Based on the feedback we have received since Monday's announcement and the results of yesterday's vote, we will not be able to move forward with the Success Plan in its current form. As we have noted, the more no votes and downgraded memberships we receive causes us to liquidate additional homes and raise annual dues. The Success Plan has become cost prohibitive for the vast majority of our members as the portfolio and availability continues to be reduced. I have decided to give ourselves 2 more weeks to evaluate our options and opportunities. We will honor reservations through November 29th at a minimum. I understand and acknowledge this is difficult for everyone. I will be in touch towards the end of next week with an update on our progress. Thank you for your patience. Who knows, the message really doesn't tell us anything at all. Obviously the results from yesterday were bad but we don't know the details. Maybe it's just me but what the heck is the September 14th reference about? Anyone? Another two weeks of endless speculation |

exactly gabby .. i will take two more weeks of a maybe we can save it compared to a down the drain decision now .. my guess and only a guess, is that credit lines and some lenders may have pulled the plug around that time I am getting a cigar and pretending I am out of the woods on this for the next 5 minutes and then back to reality .. it aint over till it's over .. brilliant gabby |

sep 14 is when ue presumably walked away from the table. there is no buyout. too much debt. only thing i see is that ck hashes out a bulk sale of properties with ue to transfer members with some equity and deposit. contrary to the opinion of a lot of people, ck is a decent man. he got caught with the wrong plan at the wrong time. |

Our personal experiences with this organization are dramatically different so it pretty much makes me sick every time someone tells me what a great guy CK is when he sold me down the friggin' river at the tail end of this miserable journey. Tell you what - I'll stop calling him a rat bastard and you (and anyone else that would invite CK into your home) stop telling me how decent he is. Do we have a deal? |

There was one membership sold the day after the merger fell apart. Heath was not yet aware that the merger was totally off and accepted a $10K deposit from the member. This is the member that posted that HCC had taken his payment after the merger was terminated. HCC refunded the $10K to him. I believe that HCC has stated that this is the only membership fee taken after the merger was finally terminated. Here is Christian's quote: "The merger died on the 14th and we were in a state of flux and made a mistake. Of course we refunded him and should not have taken the deposit on the 15th."
